RODRIGO HERNÁNDEZ, born Mexico City, April 18, 1964; admitted 1988, Mexico. Education: Escuela Libre de Derecho, Mexico City (Attorney at Law 1987); Universidad Panamericana, Mexico City (Postgraduate in “Amparo” [Constitutional Protection], 1989). Member: The International Legal Fraternity Phi Delta Phi; Barra Mexicana, Colegio de Abogados, A.C. [Mexican Bar Association]; Asociacion Nacional de Abogados de Empresa, A.C. [National Association of Corporate Attorneys]. LANGUAGES: Spanish, English and French.

PRACTICE AREAS: Civil, Mercantile and Administrative Litigation and Corporate Law. His practice focuses on complex litigation cases before state and federal courts, on commercial, corporate, tax, environmental and energy matters, especially in Constitutional Protection Process (“Juicio de Amparo”).

Rodrigo’s experience includes cross-border litigation and judicial assistance for the execution of foreign final judgments in Mexico. He has participated in several occasions as an expert witness in Mexican legal matters before U.S. state and federal courts. He has also participated in the effective implementation of the Oral Adversarial System in Mexico’s criminal procedure, sponsored by the United States Agency for International Development (USAID).

Professional Experience: From 1988 to 1992 worked at “Instituto Nacional de Bellas Artes” [National Institute of Fine Arts] as Head of the Litigation Department; from 1992 to 1993 worked in the Law Firm “Hegewisch Abogados, S.C.” as Corporate and Trial Lawyer; from 1993 to 1995 worked at “Fondo Nacional de Fomento al Turismo” (FONATUR) [National Tourism Fund]; from 1995 to1996 worked at the Law Firm “Krasovsky-Andere, S.C” in Tijuana, B.C., as Corporate and Trial Lawyer; in 1996 founded the Law Firm “Hernandez Guerrero y Asociados, S.C.” in Tijuana, B.C.; in March 1, 2001 he joined this Law Firm as Partner, where he continued his practice until November 2014; in 2015 he joined the Litigation Practice Group, of the Law Firm Haynes and Boone, S.C. (Mexico City office) where he worked until November 30, 2018. In December 1, 2018 he rejoined again this Firm, now as Of Counsel where he continues his practice.


Legal representation before State and Federal Courts, both as Plaintiff/Petitioner and Defendant/Respondent, in adversarial proceedings and Alternative Dispute Resolutions (conciliation and mediation).

Federal Administrative Litigation

  • • Successful legal defense before the Federal Administrative Court of a corporation engaged in the transportation and supply of liquefied petroleum gas located in Northern Mexico, against the cancellation of its governmental permit and undue execution of its fulfillment guarantee, determined by the Energy Regulatory Commission.
  • • Successful legal defense before the Federal Administrative Court of a mining corporation against an undue resolution imposing the obligation to perform and execute an Indigenous Consultation, issued by the Ministry of Environmental Protection.
  • • Successful legal defense before the Federal Administrative Court of a mining corporation located in Northern Mexico, against the determination of fines by the National Water Commission, derived from an alleged spill of hazardous substances.
  • • Successful defense before Federal District Courts of a corporation engaged in the production and manufacturing of auto parts, against administrative proceeding initiated in the State of Mexico, without the appearance of the defendant, for lack of service of process thereto.
  • Federal Commercial Litigation

  • • Successful legal defense before Federal District Courts of a mining corporation against a royalties payment claim, allegedly derived from a Transfer of Mining Concession Rights Agreement.
  • • Successful legal defense before State Courts in Torreon, Coahuila, of a mining corporation against a payment claim allegedly derived from a Transfer of Mining Concession Rights Agreement.
  • • Successful judicial collection before Courts of Mexico City, on behalf of a corporation engaged in the telecommunications technology against a cellular phone company.
  • • Successful legal defense before State Courts in Tijuana, Baja California, of a corporation engaged in the operation of Gas Stations, against a claim derived from the alleged breach of a Trust Agreement.
